Advisory Division

  • What are the functions and roles of the Syariah Section, Attorney General's Chambers?
    The main function of the Syariah Section is to give legal advice and comments on matters relating to the implementation, enforcement and drafting of Syariah laws at the Federal level referred to by the Government and its agencies.

    Among the issues which are often referred to this Section are issues on conflict of jurisdiction between civil and Syariah courts, such as change of religion and conversion of Islam by one of the non muslim spouses and issues relating to the interpretation of the Constitution pertaining to the religion of Islam, gender equality, human rights, enforcement of Syariah laws, implementation of Islamic family laws, development of Syariah judiciary system and Islamic transaction (muamalah), banking and finance.

    Syariah Section also carries out research on legal provisions of the Federal laws to ensure its consistency with Syariah law. Should there be any inconsistencies between the provisions of the Federal and Syariah laws, proposals will be submitted to amend the provision so that it is consistent with Syariah laws.

    Apart from that, this Section also organizes Community Syariah Meetings to discuss any issues which arise from time to time on the enforcement and drafting of Syariah laws.
  • Do the Ministries, Departments and State Governments have legal advisors?
    The main function of the Syariah Section is to give legal advice and comments on matters relating to the implementation, enforcement and drafting of Syariah laws at the Federal level referred to by the Government and its agencies.

    Among the issues which are often referred to this The Attorney General's Chambers have placed legal officers as the Legal Advisor at the Ministries and Departments to provide legal advice on legal matters arising at the Ministries and Departments.

    Legal advice to the State Governments in Peninsular Malaysia is given by the legal officers who are placed at the States as the State Legal Advisor.

    Legal advice to Sabah State Government and Sarawak State Government is given by the Sabah Attorney General and Sarawak Attorney General, respectively.

    The role of the Advisory Division is to provide legal advice referred to it by the Government, including Yang di-Pertuan Agong, Cabinet, any Minister, Ministries, Departments and Government agencies as well as State Governments.   • Can the public seek legal opinion from the Attorney General's Chambers?
    The role of the Advisory Division is to provide legal advice referred to it by the Government, including Yang di-Pertuan Agong, Cabinet, any Minister, Ministries, Departments and Government agencies as well as State Governments. For further information, please refer to the Advisory Division Profile. Clause (2) Article 145 of the Federal Constitution provides that it shall be the duty of the Attorney General to advise the Yang di-Pertuan Agong or the Cabinet or any Minister upon such legal matters. Hence, the Attorney General's Chambers do not have the legal capacity to provide legal advice to the public on any matters.
