    EXTENSION AND MODIFICATION WORK PROCESS
     

    Request or instruction for extension and modification.

    Extension and modification process commences when there is instruction or request to do so from the Attorney General, Commissioner of Law Revision/Deputy Commissioner of Law Revision (CLR/DCLR), Ministries or department concern.

    Research

    To research on the proposed extended and existing laws (if any) applicable in that particular state together with all the amendments.

    Comparative studies on the relevant laws

    Identify whether the states of Sabah, Sarawak or the Federal Territories of Kuala Lumpur, Labuan or Putrajaya have existing laws similar to the proposed extended law. If they do, comparative studies of both laws need to be done to ensure the compatibility of the proposed extended law with the existing law and that it suits the requirements and needs of the relevant states.

    Cabinet approval and consent of parties

    To liaise with the relevant Ministries/Departments regarding policy matters and consent of the States/parties concerned in respect of the proposed extension and modification of the law.

    Extension and modification draft order

    To prepare draft extension and modification order taking into consideration the policy decision of the government and special requirements and needs of the relevant States.

    Comment by Ministries/Departments concern

    Submit the draft order to the Ministries or Departments concerned for comments.

    Approval by CLR/DCLR

    Submit the draft order to the CLR/DCLR for comments and approval.

    Amendment

    Amend the draft order according to the CLR/DCLR’s comments (if any) and resubmit it to the CLR/DCLR for approval.

    Approval by Drafting Division

    Submit the draft order to the Drafting Division for comments in terms of formatting, grammar and terminology.

    Drafting Division’s comments

    Make the necessary amendment (if any) in accordance with the Drafting Division’s comments.

    Final approval

    Submit the amended draft Order to the CLR/DCLR for final approval.

    Submit the final draft order

    Forward the finalized draft order to the Ministries/Departments concerned for gazette.
