| The Public Prosecutor adheres to the following principle in undertaking his prosecutorial functions: |
"It has never been the rule, that suspected criminal offences must automatically be the subject matter of prosecution. The Public Prosecutor prosecutes wherever it appears that the offence or the circumstances of its commission is or are of such a character that a prosecution in respect thereof is required in the public interest. This is still the dominant consideration. However the Public Prosecutor must at all times bear in mind that wrong decision either way can have disastrous consequences affecting not only the suspect but, in certain circumstances, the whole community. Further, if a guilty man is not prosecuted, he may go on to cause untold further harm; yet if an innocent man is prosecuted, he and his family may be seriously affected even if the offence is comparatively minor and he is ultimately acquitted."
