    Royal Malaysian Customs

    Objectives

     
    • To ensure that all investigation papers are complete and that evidence is sufficient before proceeding with prosecution.

    • To ensure that legal advice given to the Royal Malaysian Customs on advisory and civil matters are given expeditiously and in accordance with the Federal Constitution and all other written laws in force.

    • To ensure that Bills and other legal documents drafted or vetted are consistent with the Federal Constitution and in accordance with legislative drafting norms.

     

    Functions

    • To conduct appeals in the High Court, Court of Appeal and Federal Court.

    • To conduct criminal trials in the Magistrates’ Courts, Sessions Courts and High Courts for offences under the Customs Act 1967, Sales Tax Act 1972, Service Tax Act 1975, Excise Act 1976 and the Dangerous Drugs Act 1952.

    • To conduct civil trials in the Magistrates’ Courts, Sessions Courts and High Courts where the Government of Malaysia (Royal Malaysian Customs) is a party to the action.

    • To study investigation papers submitted by the Royal Malaysian Customs and decide whether to institute prosecutions of otherwise.

    • To give legal advice on any legal issue raised by the Royal Malaysian Customs.

    • To draft Bills and rules and to vet all draft agreements and memorandums of understanding submitted by the Royal Malaysian Customs.
