    Legal Advisory Division Ministry Of
    Domestic Trade And Consumer Affairs (MDTCA)

     

    Objectives

     

    The objectives of Legal Advisory Division, Ministry of Domestic Trade and Consumer Affairs are as follows :-


    • to ensure legal advise concerning any issues under MDTCA are given swiftly, accurately and in compliance to the legislations which are enforced by MDTCA;
    • to ensure that the agreements and other legal documents are in accordance with the law and protect Government’s interest;
    • to ensure that all Bills and Subsidiary Legislations are proper in the context of drafting and not in contradiction to Constitutions or any written law;
    • to ensure that investigation and investigation papers are complete and fulfill the requirements for the purpose of prosecution; and
    • to ensure that the coordination of civil cases brought against and by MDTCA are in order and protect government’s interest.

    Functions

     

    Functions of Legal Advisory Division, Ministry of Domestic Trade and Consumer Affairs are :-


    • to give legal advise concerning matters referred to it by any Divisions and Units under MDTCA;
    • to draft or vet legal documents such as agreements, memorandum of understanding and multi lateral agreements in which MDTCA is a party to ensure that Government’s interest are protected;
    • to legislate or vet Bills and subsidiary legislations concerning the matter under MTDCA’s jurisdiction to ensure that its reflects the MDTCA’s policy;
    • to give legal advice and instruction concerning investigation papers and prosecution when it is referred to by Enforcement Division, MDTCA;
    • to coordinate civil case which is taken by or against MDTCA;
    • to attend meetings by MDTCA’s invitation and to give legal opinion on matters thereby discussed to ensure that any policy which are made are in accordance with the law; and
    • to attend the Parliament in which to give any legal advise when it is required by Minister of Domestic Trade and Consumers Affairs.
