    Multilateral Trade, International Arbitration and Disputes Unit
    • Multilateral Trade, International Arbitration and Disputes Unit deals with international legal issues which is related to matters pertaining to maritime boundary and territorial disputes between Malaysia and other states which is pending or is brought before international third party adjudication namely the International Court of Justice (ICJ), Arbitration under Annex VII of the United Nations Convention on the Law of the Sea 1982 (Annex VII Arbitral Tribunal), International Tribunal for Law of the Sea (ITLOS) and the Permanent Court of Arbitration (PCA). Multilateral Trade, International Arbitration and Disputes Unit also handles matters submitted for resolution in the International Centre for Settlement of Investment Disputes (ICSID).

    • Multilateral Trade, International Arbitration and Disputes Unit handles and is responsible for the following matters:
      • Providing legal advice on matters relating to the maritime boundary and territorial disputes;
      • Undertaking legal, historical and archival research domestically and internationally in all aspects of maritime boundary and territorial disputes for the purpose of preparing and strengthening the case for the Government of Malaysia;
      • Representing the Attorney General’s Chambers in the inter-agency meetings for the purpose of preparing Malaysia’s position in resolving the maritime boundary and territorial disputes;
      • Representing the Attorney General’s Chambers and the Government of Malaysia for meetings with foreign States for the resolution of disputes diplomatically before further action is undertaken to resolve the dispute before an international third party adjudication;
      • Make legal preparations for trial before an international third party adjudication;
      • Representing the Attorney General’s Chambers and the Government of Malaysia at the hearing before international third party adjudication bodies as the ICJ, ITLOS, Annex VII Arbitral Tribunal, PCA and ICSID in relations to issues which involves disputes between Malaysia and other foreign States. Special Projects and Research Unit was fully involved in the recently concluded dispute on Land Reclamation by Singapore in and around the Straits of Johor between Malaysia and Singapore before ITLOS and Annex VII Tribunal as well as the Advisory Opinion on the Legal Consequences of the Construction of a Wall by Israel in the Occupied Palestinian Territory before the ICJ;
      • Collaborating with domestic and international experts in their respective fields to assist the Attorney General’s Chambers to render an effective, complete and comprehensive legal advice in matters with respect to maritime boundary and territorial disputes; and
      • Providing legal advice on other international legal disputes such as civil disputes between Malaysia and foreign States/individuals.
