    Meeting of Heads of Drafting Offices for the Asia Region Kuala Lumpur, Malaysia

    The Meeting of Heads of Drafting Offices for the Asia Region was held at the Istana Hotel, Kuala Lumpur from 28 till 29 January 2008. 15 representatives from various countries and departments namely the Ministry of Law, Justice & Parliamentary Affairs of Bangladesh, the Attorney General’s Chambers of Brunei and the National Law Reform Commission of Maldives, and the Attorney General’s Chambers of Sri Lanka participated in this Meeting. The welcoming remarks was delivered by YBhg. Datuk Nor Bee binti Ariffin, Parliamentary Draftsman of Malaysia.

     
    Objective of the Meeting

    The primary objective of the meeting is for participants to identify the causes for shortage of drafters or lack of drafting capacity in their drafting offices.

    Each country may have its own peculiar problems which would need specific solutions, others may not share the same problems. A training course may be one solution, but there could be others that the meeting will able to identify.

    Khazanah Istilah Undang-Undang

    The Drafting Division has prepared a list of legal terminologies for usage in preparing the national language text of any law drafted or vetted by this Division. In 1991, the list has been updated and kept in the electronic data terminal with electronics search facilities.

    The process of updating and revising the legal terminologies has been done continuously by the Jawatankuasa Istilah Undang-Undang Bahagian Gubalan. With the support from the Information Technology Unit, Attorney General’s Chambers the updated Khazanah Istilah Undang-Undang are accessible within the Network Neighbourhood.

     
    Index of Subsidiary Legislation

    To facilitate accurate reference to subsidiary legislation, a Legal Assistant from each Unit is assigned to prepare an index of subsidiary legislation for laws under the respective Units. This task has commenced since 2001.The sources for preparing this index come from the Chamber’s Library and the files in the Drafting Division. The Legal Notification (A) (P.U. (A)) is being separated from Legal Notification (B) (P.U. (B)) and Gazette Notification (G.N.).

     

    Index of Parliamentary Questions

    Drafting Division has established a committee to collect and update the index of all the Parliamentary Questions which have been referred to the Attorney General’s Chambers according to subject matter to ensure consistency in preparing answers should similar questions be raised in the future.

     

    Collection of Legal Opinions

    A committee has been formed to collect legal opinions prepared by the Drafting Division in the course of drafting laws. The legal opinions are indexed according to subject matter, such as, General, Finance, Local Government, Transportation, Constitution, Subsidiary Laws, Local Authority, Interpretation and Discipline. This index is stored in the network neighbourhood and it is accessible to all legal officers in the Drafting Division.

     

    Internal Training

    Training sessions
    National language class

    The Drafting Division has conducted internal training sessions for the benefit of its officers. During these training sessions, officers are given lectures on legislative drafting etc. Drafting problems faced by the officers in the course of their work are resolved during these training sessions. These training sessions shall be on-going exercises catered to meet the requirement of the officers.

    Classes on the national language had been conducted by the officers from Unit V, Drafting Division for the benefit of all officers in the Drafting Division. The main objective is to nurture the habit of using correct national language especially in drafting the law. This Division has also collaborated with the Law Revision and Law Reform Division to hold a Diploma in Translation organized by Dewan Bahasa dan Pustaka on 8-12 August 2005 and 22-30 August 2005.
