    WORK SCOPE OF UNITS

     

    A. Municipal Section

    Unit 1- Constitutional and Legal Affairs Unit

    • Provides legal advice/opinion to the Ministries, Government departments and various Government agencies on matters which, among others, relates to the Federal Constitution, Cabinet, Parliament, election, land law, local government, administrative law, public service and various questions on interpretation of law such as matters relating to the security and finance.

    • Provides legal advice to other Ministries, Government departments and various Government agencies for any legal issues in relation to preparing bills and subsidiary legislation, as well as vetting and drafting various types of agreements.

    • Provides opinion and input for various forums such as the Public Services Commission Meeting, Meetings between the Federal Government and State Government, Meeting of the Heads of Secretary General and Heads of Service, National Land Council, Conference of Rulers, National Higher Education Council, National Council for Local Government, National Physical Council and Land Executive Committee for Federal Territories of Kuala Lumpur, Labuan and Putrajaya.

    • Represents the Attorney General’s Chambers in the Disciplinary Board of certain Government departments.

    Unit 2- Information and Communications Technology Unit

    • Provides legal advice/opinion for Information and Communications Technology (“ICT”) projects, including issues arising from the present as well as post implementation of the projects.

    • Involved in vetting and drafting agreements for ICT projects to be implemented by Government agencies such as e-KL and e-Services.

    • Involved in negotiations on ICT projects managed by the Modernisation of Administration and Management Planning Unit (MAMPU).

    • Provides legal advice/opinion to the Ministries, Government departments and various Government agencies on current issues in matters relating to cyber laws and ICT, for example websites and blogs which contravene the laws of the country .

    • Represents the Attorney General’s Chambers in the committees set up for electronic projects, national advisory committees, any committees set up by the Government to discuss the drafting of cyber laws as well as international workshop involving ICT and cyber laws.

    Unit 3-Privatization Unit

    • Directly involved in the implementation of privatization projects.

    • Represents the Attorney General’s Chambers in the Privatization Committee set up at the Economic Planning Unit, Prime Minister’s Department, to ensure that a proposed privatization project can be implemented by the Government in accordance with the laws.

    • Actively involved in the course of negotiating a privatization agreement with the concession companies in ensuring that the terms of the privatization agreement are in order and protect the Government’s interests and public interest.

    • Provides legal advice on numerous issues arising from post-privatization of the projects.

     

    B. Syariah Section

    Unit 1-Interaction Between Syariah and Civil Law Unit

    • This Unit is responsible on these matters –

      • Constitutional issues on Islam and Syariah;
      • Interaction between Syariah and Civil Law; and
      • Harmonization of Syariah and Civil law
    • Attends meetings, discussions, negotiations on legal matters relating to administration of Islam.

    • Involved in preparation and handling of cases relating to Syariah and Islam.

    • Conducts research and prepares opinions from Syariah perspectives on the interpretation of the Federal Constitution relating to the administration of Islam, relationship between the Federal and State, jurisdiction of the courts, international conventions/treaties and conflict between civil and Islamic law with a view to give a harmonised reading and to resolve the conflict of laws.

    Unit 2- Islamic Family Law and Syariah Judicial System Development Unit

    • The main task of this Unit is to advise the Government from Syariah point of view on the following matters:

      • Islamic Family Law;
      • Islamic administration and Syariah judicial system;
      • Conflict between Syariah and Civil and Criminal laws/procedures;
      • Muamalat principles; and
      • International conventions and treatie
    • Conducts studies and researches on the development of the administration of Syariah Judicial and Legal System.

    • Drafts and introduces new model of laws in order to enhance the effectiveness and efficiency of Syariah Judicial and Legal System.

    Unit 3- Islamic Banking and Finance Unit

    • Conducts studies and legal research and also provides legal advice from the Islamic law perspective in matters relating to muamalat, takaful, banking and finance.

    • To propose for any amendments or reform if necessary to the laws to bring it in line with the Islamic laws.

    • Conducts research in new areas of potentially commercialized areas of trust hibah and Islamic pawn broking (ar Rahn).

    • Ensures that existing legislation are harmonised with Islamic principles to enable business activities are syariah compliant and to promote diversified range of Islamic financial services.
